Elmhurst police find stolen handgun in convicted felon's car: prosecutors

Daniel Medina-Guerrero

A Chicago felon has been denied pre-trial release for allegedly possessing a loaded handgun, according to prosecutors.

Daniel Medina-Guerrero, 27, faces one count of armed habitual criminal, one count of unlawful use of a weapon by a felon and multiple misdemeanor and petty traffic offenses.

The charges stem from an incident that occurred around 3:30 p.m. on Monday in the 600 block of West Lake Street. Prosecutors say detectives with the Elmhurst Police Department were conducting surveillance in the area and waiting for Medina-Guerrero, who was a suspect in an alleged fleeing and eluding incident on Dec. 15.

Medina-Guerrero allegedly drove to the Lake Street location and exited a vehicle. At that time, detectives took him into custody for driving while having his license revoked.

While searching the vehicle, prosecutors say they found a stolen, loaded, SAR-9 9mm handgun, which was underneath the driver's seat of the vehicle.

Officers later learned that the handgun was reported stolen out of Dayton, Ohio in January 2023.

"The law is crystal clear, as a convicted felon, Mr. Medina-Guerrero has forfeited his right to legally possess a firearm," said DuPage County State's Attorney Robert Berlin "I commend the Elmhurst Police Department whose continued efforts on a fleeing and eluding case led to the removal of an illegal weapon from our streets and serious charges against the man who was allegedly in possession of that weapon."

Medina-Guerrero’s next court appearance is scheduled for Jan. 21.
